• Constitutional production • Corresponding articles of the Parliament Mazhilis Resolution "Regulation of the Parliament Mazhilis of the Republic of Kazakhstan" Acting legislation of the Republic of Kazakhstan concerning the Constitutional Council activity: corresponding articles of the Parliament Mazhilis Resolution "Regulation of the Parliament Mazhilis of the Republic of Kazakhstan", 1996, February 8 (Extract) The Parliament Mazhilis in compliance with the Constitution of the Republic of Kazakhstan may appeal to the Constitutional Council of the Republic regarding consideration of as to the compliance with the Constitution of the Republic of the laws and international treaties, before they are not have been joint into force in Kazakhstan, as well as other documents considered by the Mazhilis. The Parliament Mazhilis may also request the Constitutional Council of the Republic to officially interpret the standards of the Constitution of the Republic. The request may not be send in connection with cases which are under Constitutional Proceedings. Paragraph 58 The Chairman of the Mazhilis or not less than one-fifth of the total number of deputies of Parliament may apply to the Constitutional Council of the Republic. In the latter case, the list of full names of deputies shall be enclosed to the Application to the Constitutional Council of the Republic. The suggestion to apply to the Constitutional Council shall be submitted by a committee, a group of deputies, a faction on the plenary session of the Chamber. Having received a suggestion to apply to the Constitutional Council from a committee, a group of deputies, a faction the Chairman of the plenary session of the Chamber shall call for debate on the suggestion within one hour whereupon it should be determined, by means of roll call vote electronic system if the number of deputies is sufficient to apply to the Constitutional Council. In case the indicated number of votes are cast for, the Chairman shall assign the General Department of the Chamber Administration to prepare within three days the application and to submit it to the Constitutional Council. Paragraph 59 The Constitutional Council of the Republic shall issue a decision within one month period upon receipt of the application. The Resolution of the Constitutional Council shall be announced by the chairperson at the first plenary session of the Chamber after it is returned to Mazhilis. |

11 January, 2012. On January 06, 2011 Constitutional Council passed the supplementary resolution on the application of the Central electoral commission “Of interpretation of the resolution of Constitutional Council of April 2004 № 5 “Of checking the Constitutional law “Of making amendments and additions into the Constitutional law “Of lections in the Republic of Kazakhstan” to its compliance with Constitution concerning the possibility of conducting elections to representative bodies of the Republic in Zhanaozen (Mangystau oblast) that is in state of emergency.
06 January 2012. Constitutional Council announced the supplementary resolution on the application of the Central electoral commission “Of interpretation of the resolution of Constitutional Council of April 2004 № 5 “Of checking the Constitutional law “Of making amendments and additions into the Constitutional law “Of lections in the Republic of Kazakhstan” to its compliance with Constitution.
